Much has been written about the Corporate Manslaughter and Corporate Homicide Act 2007 which came into force on 6 April 2008, including the potentially catastrophic financial penalties which may be imposed upon an operator if it is found liable under the new legislation.
Not surprisingly, the best time for an operator to act is long before they are involved in a fatal accident. For many larger PSV operators it may be a question of ‘when’ rather than ‘if’ one of their vehicles becomes involved in a serious accident (fatal or not).
